Prokurator mo\u017ce zwr&oacute;ci\u0107 si\u0119 do s\u0105du o przed\u0142u\u017cenie zakazu na okres 3 miesi\u0119cy (np. przy recydywie). Istnieje mo\u017cliwo\u015b\u0107 skazania na kar\u0119 od 1 do 2 lat pozbawienia wolno\u015bci, gdy oskar\u017cony pope\u0142ni\u0142 ten sam czyn w ci\u0105gu trzech lat po pierwszym wyroku.<\/p>\n<p><\/font><\/span><\/p>\n<p><span><font face=\"Arial\">Belgijskie ustawodawstwo nie czyni r&oacute;\u017cnicy mi\u0119dzy kierowcami, a rowerzystami, ale<strong>priorytetem s\u0142u\u017cb policyjnych i wymiaru sprawiedliwo\u015bci nie s\u0105 nietrze\u017awi rowerzy\u015bci<\/strong>.<br \/>Na pytanie o stosunek Belg&oacute;w do pijanych rowerzyst&oacute;w odpowiedziano mi, \u017ce w europejskim programie bada\u0144&nbsp;<strong>SARTRE 4<\/strong>&nbsp;s\u0105 dwa pytania na temat spo\u0142ecznej akceptacji jazdy na rowerze pod wp\u0142ywem alkoholu, a wyniki b\u0119d\u0105 dost\u0119pne pod koniec tego roku.<\/p>\n<p><\/font><\/span><\/p>\n<p><span><font face=\"Arial\">Nikt nie posiada danych o liczbie z\u0142apanych pijanych rowerzyst&oacute;w, ani o typowych karach dla nich, co tylko pokazuje z jak niewielk\u0105 atencj\u0105 traktuje si\u0119 ten problem. 34% rowerzyst&oacute;w uczestnicz\u0105cych w wypadkach drogowych zosta\u0142o przetestowanych na obecno\u015b\u0107 alkoholu i z tych 34% os&oacute;b nietrze\u017awych jest 4% rowerzyst&oacute;w. Oczywi\u015bcie w takich sytuacjach s\u0105 oni karani.<\/p>\n<p><\/font><\/span><\/p>\n<p><span><font face=\"Arial\">Je\u015bli nietrze\u017awy rowerzysta zachowuje normalnie tzn. ma o\u015bwietlenie, nie \u0142amie przepis&oacute;w ruchu drogowego, to cho\u0107 teoretycznie policja mo\u017ce sprawdzi\u0107 jego trze\u017awo\u015b\u0107, to&nbsp;<strong>ryzyko test&oacute;w jest bardzo niskie<\/strong>. Je\u017cd\u017c\u0105c normalnie mo\u017cesz liczy\u0107, \u017ce kontroli nie b\u0119dzie. Policjant mo\u017ce zdecydowa\u0107 si\u0119 na skontrolowanie bardzo pijanego rowerzysty, u kt&oacute;rego wida\u0107 np. problemy z zachowaniem r&oacute;wnowagi, ale priorytetem w Belgii jest jazda pod wp\u0142ywem alkoholu \/ narkotyk&oacute;w u kierowc&oacute;w samochod&oacute;w\/bus&oacute;w \/samochod&oacute;w ci\u0119\u017carowych, a nie u rowerzyst&oacute;w. Since the first of January of this year we have to multiply the fines by 6. The reason is that otherwise we have to adapt all fine amounts in all our legislation again. This system (our index) will through one new law adjusted the fines.<\/font><span><br \/><\/span><font face=\"Arial\">Fines are always multiplied by 6 (index) in case the fines are pronounced by judges. The min fine 137,5euro also increase to 150 euro.<\/font><span><\/p>\n<p><\/span><\/em><\/span><\/p>\n<p><em><span lang=\"EN-US\"><font face=\"Arial\">Drunk cyclist can lost driving licence as often as he will be checked and be convicted by judge.<\/font><span><br \/><\/span><font face=\"Arial\">There will be a driving ban of 3 hours in case the person is tested between 0,22 mg\/l and 0,35mg\/l and a driving ban of 6 hours in case the person has a positive check above 0,35mg\/l<\/font><span><br \/><\/span><font face=\"Arial\">Driving ban is a safety measure. This means that law makes it possible that after a positive breath test you aren&rsquo;t driving for a few (3 or 6) hours. This means the person can&rsquo;t drive or leading his bike during this period! The person can go home on foot. He can only bike again after a new, negative breath test.<\/font><span><br \/><\/span><font face=\"Arial\">When a person is above 0,35mg\/l the prosecutor can decide the immediately withdrawal of the driving licence for a period of 15 days. The prosecutor can ask the police court a prolongation of the period with 3 months (two times 3 months is possible).<\/font><span><\/p>\n<p><\/span><\/span><\/em><\/p>\n<p><em><span lang=\"EN-US\"><font face=\"Arial\">You can lose your licences for a longer period, even permanently, when the judge decides that your licence is declined.<\/font><span><br \/><\/span><font face=\"Arial\">150 Euros have to been paid on the spot. When the infraction is to severe the judge will decide which fine you have to pay.<\/font><span><\/p>\n<p><\/span><\/span><\/em><\/p>\n<p><em><span lang=\"EN-US\"><font face=\"Arial\">The two reactions are possible above 0,35mg\/l: in case of big actions the police makes an agreement with the prosecutor that in case they have a person who is above 0,35 mg\/l there will be an withdrawal. In case of a regular check, accidents or suspicion the police officer will call the prosecutor and ask him what to do.<\/font><span><\/p>\n<p><\/span><\/span><\/em><\/p>\n<p><em><span lang=\"EN-US\"><font face=\"Arial\">Our legislation doesn&rsquo;t make a difference between car drivers of cyclists. But: the priority of our police services and justice system isn&rsquo;t cyclists who are driving under influence.<\/font><span><br \/><\/span><font face=\"Arial\">There exists a prison sentence from 1 till 2 years when a person is convicted for the same offence within three years after his first conviction.<\/font><span><\/p>\n<p><\/span><\/span><\/em><\/p>\n<p><em><span lang=\"EN-US\"><font face=\"Arial\">In the European research program SARTRE 4 there is are two questions about the social acceptance of cycling under influence. The results will be available at the end of this year.<\/font><span><br \/><\/span><font face=\"Arial\">No information available about number of cyclist per year who broke the law and Police catch them. From our accident data we learn that 34% of the cyclists involved in road accidents are tested and from those 34% 4% is above the limit. When this is the case they will be punished.<\/font><span><br \/><\/span><font face=\"Arial\">If cyclist behave normal &ndash;have lights and so on, but have some alcohol in blood Police can check him but the risk of being checked will be very low! When you act normal, you can ride on without check.<\/font><span><br \/><\/span><font face=\"Arial\">Police officer can decide to control a very drunk cyclist (who have some problem with proper control of the vehicle). But the priority in Belgium is driving under influence of alcohol\/drugs by car-bus and\/or lorry drivers and not by cyclists.<\/font><span><\/p>\n<p><\/span><\/span><\/em><\/p>\n<p><font face=\"Arial\"><em><span lang=\"EN-US\">We don&rsquo;t make problems like in Poland &ndash;as I wrote before: the focus on driving under the influence of alcohol is in Belgium on car- lorry drivers.
