Musisz zrozumie\u0107, \u017ce nie ma rozró\u017cnienia mi\u0119dzy pojazdami z silnikiem i innymi pojazdami. Jest zero tolerancji we wszystkich przypadkach.<\/font><\/p>\n

Tak wi\u0119c, rowerzysta pope\u0142nia wykroczenie, nawet je\u015bli wypije tylko troch\u0119 alkoholu, ale istnieje ró\u017cnica mi\u0119dzy kierowcami pojazdów silnikowych i kieruj\u0105cymi pojazdami bez silnika np. rowerzystami, a mianowicie: kierowca pojazdu silnikowego pope\u0142nia wykroczenie administracyjne je\u015bli zawarto\u015b\u0107 alkoholu w jego krwi jest ni\u017csza ni\u017c 0,8‰, a przest\u0119pstwo, je\u017celi st\u0119\u017cenie alkoholu we krwi jest powy\u017cej 0,8 ‰. Kieruj\u0105cy pojazdami bez silnika pope\u0142niaj\u0105 w obu przypadkach tylko zwyk\u0142e wykroczenie (administracyjne) i musz\u0105 zap\u0142aci\u0107 odpowiednio 30000 lub 60000 HUF (100 lub 200 euro) grzywny. Jednak\u017ce, je\u015bli rowerzysta jest sprawc\u0105 wypadku, który obejmuje powa\u017cne obra\u017cenia i ma ponad 0,8 ‰to jego wykroczenie jest uwa\u017cane za przest\u0119pstwo i o karze (grzywnie, wi\u0119zieniu) zadecyduje s\u0105d.<\/font><\/p>\n

Pijanym kierowcom pojazdów mechanicznych z zawarto\u015bci\u0105 alkoholu we krwi poni\u017cej 0,8‰(wykroczenie administracyjne) grozi 50.000-300.000 HUF grzywny (160-1000 euro), w zale\u017cno\u015bci od kategorii pojazdu i poziomu alkoholu we krwi, oraz 6-8 punktów karnych. Pijanym kierowcom pojazdów mechanicznych z zawarto\u015bci\u0105 alkoholu we krwi powy\u017cej 0,8‰(przest\u0119pstwo) je\u015bli nie spowodowali wypadku grozi kara pozbawienia wolno\u015bci do 1 roku, a je\u015bli spowodowali wypadek podczas którego kto\u015b zosta\u0142 ci\u0119\u017cko ranny to kara wynosi do 3 lat pozbawienia wolno\u015bci i tak dalej. Dodatkowo dostaj\u0105 zakaz prowadzenia pojazdów i kar\u0119 finansow\u0105 o której decyduje s\u0105d.<\/font><\/p>\n

Zarówno ja jak i moi koledzy uwa\u017camy, \u017ce jazda pod wp\u0142ywem alkoholu na rowerze nie jest akceptowalna spo\u0142ecznie. Jednak w ma\u0142ych miasteczkach, gdzie ludzie chodz\u0105 do baru, a nast\u0119pnie wracaj\u0105 do domu na rowerze jest to prawdopodobnie bardziej akceptowalne w\u015bród mieszka\u0144ców wsi.<\/font><\/p>\n

Od zesz\u0142ego roku mamy zwraca\u0107 wi\u0119ksz\u0105 uwag\u0119 na pijanych rowerzystów, ale nie mog\u0119 powiedzie\u0107, \u017ce postrzegamy ich jako du\u017ce ryzyko, bardziej jako po prostu ryzyko –na normalnym poziomie.<\/font><\/p>\n

Co do liczby pijanych rowerzystów, którzy zostali z\u0142apani podczas kontroli to mamy nast\u0119puj\u0105ce statystyki: od 1 stycznia 2011 r. do 31 sierpnia 2011 w sumie 1413 osób zosta\u0142o odnotowanych, z czego 1341 osoby zosta\u0142y ukarane lub pouczone. \u015arednia wysoko\u015b\u0107 grzywny to 36460 HUF (oko\u0142o 120 euro). Mamy dane tylko do sierpnia, poniewa\u017c zmieni\u0142o si\u0119 prawo i to wykroczenie jest rozpatrywane w ramach innej procedury (nasz system proceduralny jest bardzo skomplikowany).<\/font><\/p>\n

Nie zabieramy prawa jazdy pijanym rowerzystom.<\/font><\/p>\n

I am Lt. Col. Zsófia Szász from the Traffic Enforcement Department of the Hungarian National Police HQ. Below I will try to help you with you efforts, I hope I will succeed.<\/font><\/p>\n

First of all, I have to tell you that we do not have any research material on this issue, so I can give you only the legal background and statistics. You will see that our legislation is not permissive at all, as we have zero tolerance for all drivers. And we sometimes carry out enhanced controls targeted specifically at cyclists. They don’t like it, of course…<\/font><\/p>\n

 <\/font><\/p>\n

The first link is to our Central Statistics Office, and <\/font><\/span>directly to the publication<\/font><\/span><\/a>which comes out every year regarding all details of traffic accidents. <\/span>It is also in English, so you can read it for yourself. However, you will surely find important data on pages 28, 31, 87.<\/font><\/p>\n

As for the legislation, you can find the relevant provision in Art. 4. par. c) of the Code of Road Traffic (see <\/font>link<\/font><\/a>), the English translation is below:
4. §(1) Only that person may drive a vehicle who
c) is not under the influence of a substance which has a negative influence on driving skills, and in his\/her body there is no alcohol coming from the consumption of alcoholic drinks.<\/font><\/p>\n

You must understand that there is no discrimination between motor vehicles and vehicles, there is zero tolerance (0 promille) in all cases.<\/font><\/p>\n

So, the cyclist commits an offence even if he consumes just a little alcohol, BUT: there is a difference between motor vehicle drivers and drivers of not powered vehicles, e.g. cyclists. Namely:<\/font><\/p>\n

The motor vehicle drivers commit an administrative offence if the BAC is under 0,8, and a crime if the BAC is over 0,8.<\/font><\/p>\n

The drivers of non powered vehicles commit only an administrative offence in both cases, they just have to pay respectively 30000 or 60000 HUF (100 or 200 euros) as a fine. However, if they cause an accident which involves serious injury, AND they are over 0,8, their offence is considered a crime, too, and the sancions (fine, imprisonment) will be decided upon by the court.<\/font><\/p>\n

As my colleagues and I see it, drunk cycling is not socially acceptable in general, however, in the small villages, where men go to the pub and then home by bike, it is probably more acceptable among the villagers.<\/font><\/p>\n

We pay more attention to cyclists since last year, but I can’t say they are regarded as a high risk. Just risk, at a normal level.<\/font><\/p>\n

 <\/font><\/p>\n

As for the number of drunk cyclists who were caught in a control, I have this number: between 1st January 2011 and 31st August 2011, a total of 1413 persons were reported, of which 1341 were punished or warned. <\/span>The average fine per capita was 36460 HUF (around 120 euros). We have data only until August because the law changed and this offence is considered under a different procedure (our procedural system is very complicated).<\/font><\/p>\n

Drunk motor vehicle drivers below 0,8: administrative offence, 50.000-300.000 HUF fine (160-1000 euros), depending on the vehicle category and the BAC level), 6-8 penalty points.<\/font><\/p>\n

Drunk motor vehicle drivers above 0,8: if no accident is caused, imprisonment up to 1 year, if accident with serious injury is caused by drunk driver, up to 3 years, and so on…plus driving ban and financial penalty which is decided by the court.<\/font><\/p>\n

And your additional question: no, we do not take the driving licence from drunk cyclists.<\/font><\/p>\n
