Republika Federalna Niemiec jest bardzo liberalna dla pijanych rowerzystów. Mo\u017cna zauwa\u017cy\u0107, \u017ce \u017caden szczególny poziom alkoholu we krwi nie jest wymieniony. Jest to kwestia rozstrzygana przez s\u0105dy, które decyduj\u0105, kiedy kieruj\u0105cy „nie w stanie prowadzi\u0107 pojazdu bezpiecznie”. Powodem tych ró\u017cnych bezwzgl\u0119dnych limitów jest to, \u017ce trudniej jest prowadzi\u0107 pojazd silnikowy. Kara to zwykle grzywna. Rzadko zdarza si\u0119, \u017ce pijanego kierowc\u0119 lub rowerzyst\u0119 wysy\u0142a si\u0119 do wi\u0119zienia, ale mo\u017ce si\u0119 zdarzy\u0107 (w teorii), \u017ce po grzywnie i po wyroku w zawieszeniu tak\u0105 osob\u0119 wysy\u0142a si\u0119 do wi\u0119zienia. To by\u0142aby zwyczajna eskalacja dla przest\u0119pstw kryminalnych.<\/font><\/p>\n

Dla kierowców –ale nie dla rowerzystów – jest inna granica 0,5 promila alkoholu we krwi (ale mniej ni\u017c 1,1 promila). Przekroczenie tego limitu jest wykroczeniem („Ordnungswidrigkeit”), ale nie przest\u0119pstwem –co\u015b jak przejechanie na czerwonym \u015bwietle. Sankcj\u0105 jest grzywna do 3.000 Euro i co wa\u017cne dla zmotoryzowanych – zakaz prowadzenia pojazdów mechanicznych na okres 1 do 3 miesi\u0119cy.<\/font><\/p>\n

§24a and §25 Straßenverkehrsgesetz (StVG)
<\/font>§24a StVG, 0,5-Promille-Grenze<\/font><\/a><\/p>\n

(1) Ordnungswidrig handelt, wer im Straßenverkehr ein Kraftfahrzeug führt, obwohl er 0,25 mg\/l oder mehr Alkohol in der Atemluft oder 0,5 Promille oder mehr Alkohol im Blut oder eine Alkoholmenge im Körper hat, die zu einer solchen Atem- oder Blutalkoholkonzentration führt.<\/font><\/p>\n

§25 StVG, Fahrverbot<\/font><\/a><\/p>\n

(1) Wird gegen den Betroffenen wegen einer Ordnungswidrigkeit nach §24, die er unter grober oder beharrlicher Verletzung der Pflichten eines Kraftfahrzeugführers begangen hat, eine Geldbuße festgesetzt, so kann ihm die Verwaltungsbehörde oder das Gericht in der Bußgeldentscheidung für die Dauer von einem Monat bis zu drei Monaten verbieten, im Straßenverkehr Kraftfahrzeuge jeder oder einer bestimmten Art zu führen. Wird gegen den Betroffenen wegen einer Ordnungswidrigkeit nach §24a eine Geldbuße festgesetzt, so ist in der Regel auch ein Fahrverbot anzuordnen.<\/font><\/p>\n

W 2010 roku w\u015bród rowerzystów, którzy byli w ranni lub zabici w wypadkach drogowych w Niemczech 4,9% by\u0142o pod wp\u0142ywem alkoholu. Przez lata odsetek ten wynosi\u0142 raczej 5,5%. Stosunkowo blisko do 7% warto\u015bci tego wspó\u0142czynnika w Polsce.<\/font><\/p>\n

The alcohol limits for cyclists are not as restrictive as those for motorists.
The relevant section in the German penal code (<\/font>Strafgesetzbuch, StGB<\/font><\/a>) is §316 StGB:<\/font><\/p>\n

(1)Whosoever drives a vehicle in traffic (sections 315 to 315d) although due to consumption of alcoholic beverages or other intoxicants he is not in a condition to drive the vehicle safely shall be liable to imprisonment not exceeding one year or a fine unless the offence is punishable under section 315a or section 315c.”<\/font><\/p>\n

You will notice that no specific alcohol level is mentioned. It is a matter for the courts to decide when a driver ist „not in a condition to drive the vehicle safely”. Over the years, since 1990 jurisdiction has found with the help of medical experts that the absolute limit for motorists is 1,1 promille (parts per thousand) blood alcohol concentration\/BAC (or 0,11 as you would say) and 1,6 promille for cyclists. Above these levels, nobody can drive the respective vehicle safely. A bicycle is a vehicle (of course)<\/font><\/p>\n

<\/font><\/p>\n

The reason given for these different absolute limits is that it is more difficult to manage a motor vehicle. The sanction is usually a fine. It is rare for a drunk driver or bicycle rider to go to prison, but it could happen (in theory) after a fine and after a suspended sentence. That would be the usual escalation for this criminal offence.<\/font><\/p>\n

 <\/font><\/p>\n

For motorists –but not for cyclists –there is another limit of 0,5 promille BAC (but under 1,1 promille). Exceeding this is an offence („Ordnungswidrigkeit”) but not a crime, like running a red light. The sanction is a fine of up to 3.000 Euro and –more important to motorists –a ban to drive a motor vehicle for a period of 1 to 3 months.<\/font><\/p>\n

I could not find English translations of the German „Road Traffic Act”.
§24a StVG begins with „Whosoever drives a motor vehicle in road traffic…”Don´t be confused: The value of 0,25 mg\/l refers to alcohol in breath and equals 0,5 promille.
§25 StVG says in its last sentence that a ban to drive a motor vehicle is the usual additional sanction for a motorist exceeding 0,5 promille BAC.
In 2010, of those cyclists who were in injured or killed in Germany 4,9 % were under the influence of alcohol. Over the years, the figure was rather 5,5 %. Not far from the 7 % you quote for Poland.<\/font><\/p>\n
